Terms of Service

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and any related websites, features or services within our network. By accessing or using our services you acknowledge that you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have authority to enter into this agreement. If you do not agree, you must cease using our services.

We may modify these Terms at any time; when we do, we will update the "Last Updated" date, notify registered users by email, and display material changes prominently. Changes take effect immediately upon posting unless otherwise specified.

2. Description of Services

HALP operates specialised property discovery and business directory platforms — house and land listings, off-the-plan and new development information, boutique/luxury showcases, school zone integration, mortgage broker connections, and business directory listings (freemium model with premium subscriptions), plus supporting tools like alerts, saved searches, mortgage calculators and educational content.

Nature of service: HALP is an information and advertising platform. We facilitate connections but are not a real estate agent, developer, builder, or financial advisor. Property listing inquiries go directly to the listing agent, developer or builder — HALP does not store or access these inquiries. Contact Us / Join Us / Advertise With Us forms are managed by HALP per our Privacy Policy.

No agency relationship: HALP does not act as your agent, provide property/financial/legal/tax advice, or guarantee accuracy of third-party listings.

Availability: Services are provided "as is" and "as available". Our platform is delivered through AWS (hosting/backups), Synergywholesale (domains), Google Workspace, Stripe, Pipedrive, ActiveCampaign and Zapier. We cannot guarantee 100% uptime.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate information, be at least 18 years old, keep credentials confidential and use only one account per person. Business accounts require valid ABN/ACN. You are responsible for activity under your account. We may suspend or terminate accounts for breach, false information, fraud, non-payment or extended inactivity. You may terminate your account by contacting support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with all laws, use services only for lawful purposes, provide truthful information and respect intellectual property rights. You must not use bots/scrapers without authorisation, interfere with the platform, gain unauthorised access, reverse-engineer components, post false or harmful content, upload viruses, transmit spam, engage in phishing, violate laws, infringe IP, engage in money laundering, harass or threaten others, or misuse the platform commercially. Violations may result in suspension, content removal, legal action or referral to law enforcement.

5. Property Listings and Information

Property listings and information are provided and owned by developers, builders, real estate agents, project marketing companies and third-party data providers. HALP does not own or verify all listings, or endorse any provider. Information may change without notice; prices, availability and specifications are subject to change; images may not reflect final product. Always verify critical information directly with the property provider. We disclaim all warranties on listing accuracy, completeness, availability, fitness for purpose or title.

School zone data is sourced from government databases and third-party providers, is provided for reference only, and is subject to change. Always verify school catchment zones directly with the education department and the school before making decisions. Enrollment is not guaranteed by living in a catchment zone.

6. Business Directory Listings

To advertise you must hold a valid ABN/ACN, be a legitimate operating business, comply with advertising laws, provide accurate information and hold necessary licenses. Listings must accurately describe services, use your own business name and logo, and comply with Australian Consumer Law. Prohibited: promoting illegal goods or services, unsubstantiated claims, violating professional codes, bait advertising, discriminatory content or IP infringement.

Free listings offer basic directory presence; premium subscriptions offer enhanced visibility and features under a separate subscription agreement with auto-renewal unless cancelled.

You must respond to inquiries promptly and professionally, comply with privacy laws, maintain your own privacy policy, honour representations in your listing, and not spam prospective customers. We may remove listings for breach, credible complaints, unpaid fees, unlicensed operation or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is displayed on our website and/or in the applicable Listing Agreement, in Australian Dollars, exclusive of GST unless stated. Standard payment processing fees are included in the advertised price unless we state otherwise. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew until cancelled; you are responsible for maintaining valid payment information.

Cancellation: cancel any time before your next billing date; takes effect at end of current billing period; no partial refunds for unused time. Refunds: no refunds for voluntary cancellations; pro-rata refunds available for technical issues preventing service access; processed within 14 business days. Payment failures may result in service suspension after 7 days and listing removal after 14 days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including our logos and trademarks (HALP, House And Land Packages, Boutique Developments), website design, code, text, graphics, images, videos, data compilations and school zone data aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, publicly display, modify or use our content commercially without permission. User-generated content: you retain ownership but grant us a worldwide royalty-free licence to use, reproduce, modify and display it.

9. Disclaimers and Limitations

No professional advice: HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators and tools provide estimates only. Always consult qualified professionals for your circumstances.

Third-party relationships: HALP facilitates connections but does not control third-party conduct, is not responsible for their actions, does not guarantee third-party service quality, and is not a party to contracts between you and third parties.

Data accuracy, service availability and payment processing: while we strive for accuracy and use industry-standard security, we cannot guarantee absolute accuracy, uninterrupted access, error-free operation or absolute security. Our platform relies on third-party services (AWS, Stripe) — we are not responsible for their failures but will make reasonable efforts to resolve issues.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, officers, employees and agents are not liable for loss of profits, revenue, data, business opportunities, cost of substitute services, or any indirect, consequential, incidental, special or punitive damages arising from your use or inability to use our services.

Where liability cannot be excluded by law, our total liability is limited to A$100 for free services, or for paid services the lesser of A$1,000 or the amount you paid in the 12 months prior to the claim.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law. Where the ACL applies, our liability for breach of a consumer guarantee is limited (at our option) to re-supplying the services or paying the cost of having services re-supplied.

Indemnification: you agree to indemnify HALP against any claims arising from your breach of these Terms, your violation of law or third-party rights, your use of our services, content you submit, or your interactions with other users or third parties.

11. Dispute Resolution

Before initiating legal proceedings you agree to contact us at legal@halp.com.au with details of your dispute, allow us 30 days to investigate and respond, and engage in good faith discussions. These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of NSW courts.

For disputes not resolved informally, either party may request arbitration under ADRA rules by a single arbitrator, conducted in Sydney, with each party bearing their own costs unless otherwise determined. To the extent permitted by law, you agree disputes will be resolved individually and waive rights to class actions. Injunctive relief remains available for IP infringement, breach of confidentiality, prohibited activities or irreparable harm.

12. Special Terms — Property Inquiry Flow

Property listing inquiries are sent directly to the listing agent/developer — HALP does not store, read or process your inquiry. The advertiser becomes responsible for your information and their privacy policy governs. HALP acts as a technology conduit only.

Platform inquiry forms (Contact Us, Join Us, Advertise With Us): information is collected and stored by HALP in Pipedrive, ActiveCampaign and Google Drive; our Privacy Policy governs.

By using any inquiry form, you acknowledge that property listing inquiries go directly to advertisers, that you should review advertiser privacy policies, that HALP is not responsible for how advertisers handle your information, and that platform inquiries are managed by HALP per our Privacy Policy.

Advertisers agree to handle all inquiries in accordance with applicable privacy laws, maintain their own privacy policy, use inquiry information only for legitimate business purposes, and not spam or harass prospective customers.

13. General Provisions

These Terms, together with our Privacy Policy and any referenced terms and policies, constitute the entire agreement. If any provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in force. Our failure to enforce any provision does not waive our rights. You may not assign these Terms without our written consent; we may assign in connection with a merger, acquisition or sale of assets. Notices to you may be provided by email, on our website or in-app; legal notices to us must be sent to House And Land Packages Pty Ltd, 235 Glen Huntly Road, Elsternwick VIC 3185 or legal@halp.com.au. These Terms are written in English; any translation is for convenience only.

14. Special Terms for Specific Services

Mortgage calculators provide estimates only, use average rates and standard assumptions, may not account for all fees, do not consider your personal circumstances, and should not replace professional financial advice.

School zone data is aggregated from public government databases, provided "as is" without warranty, and subject to change without notice. Always verify with the relevant state education department and specific school.

Property alerts and notifications: by subscribing you consent to receive emails and SMS notifications; you can modify or cancel alerts at any time.

Home loan referrals: we may receive a referral fee or commission when we connect you with mortgage brokers. Brokers are independent third parties licensed under responsible lending laws; we do not guarantee loan approval; you are free to use any broker or lender.

16. Definitions

Platform — all HALP websites, mobile applications and related services. User — any person or entity that accesses or uses our services. Content — all information, text, images, data, software and materials on our platforms. Property Provider — developers, builders, real estate agents and other listing entities. Advertiser — professionals and businesses advertising in our directory. Personal Information — has the meaning given in the Privacy Act 1988. Listing — any property advertisement, business directory entry or content posted on our platforms.
